This contract is between K D & J Poodles & Yorkies,hereinafter referred to as SELLER and
_____________________________________________________________________, hereinafter referred to as BUYER(s) for the purchase of the following Toy Poodle or Yorkshire Terrier.

The following terms and conditions are agreed to between Seller and Buyer:
The above said Toy Poodle or Yorkshire Terrier is sold as for____ Pet or_____ Breeding for the total price of $______. A deposit of $250 Minimum up to $1000 depending on the price of the puppy (non-refundable)will be discussed between the buyer and the seller upon agreement of purchasing said puppy ______initials to hold said puppy, so that she not be put up for sale for anyone else. Then when s/he is 8 weeks of age and has had his/her first vaccinations and a clean bill of health s/he would be available for pick up or delivery for and added price of $______. The balance of $_______ in cash is due before the buyer may take possession of said puppy. If paid by check or credit, puppy will be held until check/credit clears buyers bank at which time the puppy would be available for pick up. Registration papers will also be held until the balance is paid in full. The buyer understands that once a deposit is made, it is a commitment to buy said dog and therefore is non-refundable.In the event that the Buyer cannot follow through with the purchase of the puppy, the deposit is forfeited and NO refund will be given. If by tragic accident the puppy were to die or be determined to have a congenital defect that prevents the puppy from being a companion animal, before the Buyer takes possession of the puppy, a suitable replacement will be given to the Buyer and no refund for the deposit will be given. The buyer will be given a choice of a suitable replacement, or may also wait for a later date when he/she may pick another suitable puppy to put the deposit towards.(NFS check will be charged $35 plus $10/day that it is still outstanding. Legal action may be taken all-legal costs will be the responsibility of the person writing the check.)
This document is made out in duplicate so that both buyer and seller may retain a copy for their records.
Buyer agrees also that he/she has received a copy of the Puppy care instructions Vital for the first 2 weeks of adjustment for this puppy and also Health Warranty information.
·Puppies being shipped via airline will be charged for purchase of small crate, health certificate, flight arrangements and transportation to airport. Buyer, according to the current airline fees, will pay flight costs.
The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, which consists of a good quality professional feed, preferably given at regular intervals, and fresh water available at all times. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision.
The Seller guarantees this puppy/dog to be of sound health and temperament at the time of this sale. The seller will provide all health records of shots and worming.The Buyer agrees to take this dog to a licensed veterinarian of his/her choice within 48 hours for a physical examination (at the buyers discretion and expense). Examination must include a stool check for parasites (both a floatation and a smear test are required). Should puppy/dog be determined to be in ill health, the cause of which is clearly attributable to the Seller,(excluding common puppy problems)the dog may, upon signed written diagnosis from said veterinarian, The seller’s veterinarian shall be allowed to examine said puppy. Provided that both the seller’s and purchaser’s vets agree that there is a life threatening incurable health defect which existed at the time of the purchase, and further, provide that the puppy has been properly cared for in purchasers possession, the seller guarantees replacement with a new available puppy of the same value, contingent on availability. Failure to have a well-puppy check-up within 48 hours renders your Health Warranty void.
·Should death occur within this 48hour period, an autopsy (at the purchasers’ expense) must be performed at a Diagnostic Laboratory Clinic to determine the cause of death. If the death was caused by a congenital defect the autopsy report must be provided to the breeder proceeding replacement with a new available puppy of the same value, contingent on availability. Purchaser will be responsible for all shipping expenses, and veterinarian expenses occurred.
·Common puppy problems occur and are neither life threatening, or non-curable and are not warranted under this limited health guarantee.
·The seller will estimate size/personality/color, etc. as accurately as possible, but because there are so many variables and factors involved in genetics, the breeder cannot guarantee these traits.
·The Buyer agrees not to use this animal for breeding unless specified at the time of sale. Unless stated at the time of sale, this dog will be on limited AKC registration. If this puppy is bought with full registration, fertility, reseeded, live birth, free whelping or descended testicles are not guaranteed with full registration.
If at any time the Buyer (or Estate thereof) can no longer retain possession of this dog, the Seller is to be notified and given first option of resuming full ownership of dog in order for the Seller to locate this dog a new home.Refunds, if any, will be at the discretion of the Breeder/ Seller. The dog will be returned with all AKC papers and medical records. Should any circumstances arise that affect the quality of life of this dog, the breeder/seller is to be informed so that they may participate in determining the dog’s future.
The Buyer agrees to contact the Seller immediately if any questions or concerns arise about the dog, such as housing, diet, health or training. The buyer agrees to keep the seller informed of any treatment as it occurs. This provides the Breeder/Seller with an opportunity to follow up on puppies and gives us important feedback and information on the health or our dogs for future generations.
Registration papers will either be given with the puppy or transferred to the Buyer immediately upon receipt from the AKC if they are still being processed.It is understood at the time of sale that this is a pet quality dog and it is representative of its breed. It is structurally and temperamentally suited as a companion and/or obedience dog. Training classes are recommended for a happy relationship between the dog and family.
Buyer releases Seller, K D & J Poodles & Yorkies, and their estate from any and all liabilities and/or damages by fault of this dog after the time of sale.
·The preceding paragraphs contain conditions established to ensure the well being of the dog, but also to uphold and maintain the reputation of quality that K D & J Poodles & Yorkies has worked diligently to establish. The Buyer’s agreements will continue for the dog’s life and the Seller will have the right to enforce the agreements.
·If Buyer is purchasing a dog that is over the age of 6 months this changes the warranty from one year to 90 days from the date of purchase. All other warranty’s will still apply to this said dog.
·If either Buyer or Seller take any legal action to enforce any part of this Contract, action shall be initiated in the county of Seller’s residence and any legal fees and court costs shall be the responsibility of the party found to be in default.

You have made a wise choice by selecting a puppy from K D & J POODLES & YORKIES. This puppy will bring you much joy and companionship for many years to come if the proper care and attention is given.
To ensure that your new puppy enjoys a happy and healthy life it is imperative that YOU (the new owner) take responsibility for its proper care.
PUPPY CARE -
Toy breeds need to “graze” during the day. If there is any old food left in the bowl always throw it away and give your pup fresh food. Small-breed puppies have higher metabolic requirements per pound of body weight than large-breed puppies, and require more protein and fat to support their energy needs. Be sure to use a quality brand (such as Iams, Purina Puppy Pro-Plan, Royal Canin, Eukenuba or Science Diet) that is specifically formulated based on the calories from protein needed for the appropriate protein-to-fat ratio.
Please give fresh water DAILY!!! CAUTION: DO NOT feed your puppy any milk, table scraps, or change your puppy’s diet in anyway. This will result in diarrhea making your puppy very ill.
STRESS
Going to a new home, being handled, traveling, or too much playtime can sometimes lead to a very stressful pup. This causes digestive problems and even diarrhea.
To assure that your new puppy will not suffer low blood sugar that is brought on by STRESS, Karo syrup or honey (1/2 teaspoon) should be added into the water during the first two weeks for the adjustment period. A product called NUTRA-CAL should also be used (approximately 1 inch twice daily) to give a new puppy the extra calories needed to keep its blood sugar from dropping.
Sometimes stressed puppies do not want to eat. Your new puppy MUST eat within 12 to 16 hours the first day you take it home or it could get weak. This may result in seizures, better known as hypoglycemia, which is LOW BLOOD SUGAR. If proper care is not given right away, it could be imminent death to your new puppy.
EMERGENCY STEPS – drizzle ½ teaspoon of Karo or Honey straight into your puppy’s mouth. Nutri-cal or bene-bac can also be used instead of Karo as it also includes extra proteins and caloric benefits.
This must be done slowly and with care so not to aspirate your puppy. This should help get your puppy’s strength back within 5 minutes. Continue with sugar water in a syringe in small amounts until you have contacted your vet. It is recommended that you immediately call your vet for further advice.

Health Warranty Information
Puppies are guaranteed healthy at the time of sale only. Your puppy has had all shots and worming that can be done in regard to its age. We represent your puppy to be of good pet quality. It is mutually agreed and understood by the aforementioned guarantee the seller makes no other warranties, expressed or implied.
Puppies must be examined by a licensed veterinarian of purchaser’s choice, within 48 hours of purchase (at the purchaser’s expense). Examination must include a stool check for parasites (both a floatation and a smear test are required). Worms and parasites are treatable at that time by the veterinarian. Failure to have a well-puppy check-up within 48 hours renders your Health Warranty void.
If the purchaser’s veterinarian finds a life threatening incurable congenital health problem (excluding common puppy problems) the seller must be informed within forty-eight (48) hours after purchase. A written report from the veterinarian must be obtained and provided to the seller. The seller’s veterinarian shall be allowed to examine said puppy. Provided that both the seller’s and purchaser’s vets agree that there is a life threatening incurable health defect which existed at the time of the purchase, and further, provide that the puppy has been properly cared for in purchasers possession, the seller guarantees to refund the price of said puppy only.
Purchaser will be responsible for all vet fees and shipping expenses occurred.

Purchaser agrees that a puppy is a lifetime commitment and guarantees a stable and permanent home for said puppy. Our goal is that no puppy will have to go to an Animal Shelter, so if at any time purchaser can no longer care for said puppy the purchaser agrees to accept responsibility to find said puppy a new and proper home.
Other than the above guarantee, K D & J POODLES & YORKIES assumes no monetary responsibility for puppies once they leave the premises. Mishandling during delivery, transportation, etc., will not be the responsibility of the seller.
Your puppy can become stressed by shipping, adjusting to a new home, being handled, changing diets, etc., and this can bring on problems which include: worms, coccidiosis, hypoglycemia, etc. Seller has no control over puppy’s environment at this time and these conditions, and vet expenses will be the purchasers’ responsibility.
Common puppy problems that occur that are either non-life threatening, or curable are not warranted under this limited health guarantee.
The seller will estimate size/personality/color, etc. as accurately as possible, but because there are so many variables and factors involved in genetics, the breeder cannot guarantee these traits.
Puppies are sold as pet quality only with limited registration. Seller does not guarantee any genetics, nor the breeding potential of any puppy. If your puppy checks out okay at it's initial required vet visit, then that's the limit of my warranty.
By purchasing a puppy from K D & J POODLES & YORKIES, you are agreeing to this warranty/guarantee. This warranty/guarantee is posted on K D & J POODLES & YORKIES web site for public veiwing. This health warranty is NOT valid without this document (signed and dated) by the purchaser, and on file in our office. You will receive a signed copy after it is returned.
Our warranty includes the following for the benefit
and protection of both the purchaser and the seller.
·To activate your Health Warranty you will need to take your puppy to a licensed veterinarian within 48 hours. Failure to have a well-puppy check within this time will render your warranty void.
·If pup is diagnosed with a life threatening congenital health defect, which existed at the time of purchase, the seller agrees to refund the price of said puppy only as in accordance with Health Warranty.
·If death occurs within that time seller/breeder will replace puppy with puppy of same value only.
Issues not warranted include:
·Hypoglycemia: this is 100% preventable. Please carefully read enclosed material in your New Puppy Package concerning prevention & treatment.
·Worms & Parasites: including Coccidia and Giardia (which are common in puppies). Our puppies are dewormed at 2, 4, 6 and 8 weeks of age. Additional treatment may be necessary. We recommend that you take a stool sample for your puppy’s Well Puppy vet-check. Worms & parasites are treatable at that time by your vet.
·Murmurs - caused by turbulence in the flow of blood through the heart, are a common problem in puppies. Innocent murmurs are not connected to a disease, but rather a normal degree of turbulence.
Canine Parvovirus- caused by exposing the new puppy to grassy areas where other animals have gone to the bathroom or tracked in canine parvovirus which is extremely contagious and can sometimes be deadly to young puppies who have not been vaccinated with all three sets of puppy shots or is older than 16 weeks of age. All new puppy owners are told that their puppies are like new born babies and should be treated like one until they are immunized completely.
Hernias: these are common in puppies and usually disappear by 6 months of age. Umbilical hernias develop if the umbilical cord is severed too closely to the abdomen.
·Non-life threatening health issues.
By purchasing a puppy from K D & J Poodles & Yorkies, you are agreeing to this guarantee.
Short and long term health & behavioral problems can occur, regardless of where you purchase your puppy. Purchasing a puppy is a commitment for a lifetime. Please make certain that you are making the right choice before you purchase any pet.

K D& J Poodle and Yorkies Bill of Sale and Guarantee Regarding
One _________Toy Poodle or Yorkshire Terrier____________ Puppy; Sex: ____ Color: _______________
This breeding establishment is under regular veterinary supervision. The above Puppy has been carefully raised under sanitary conditions and, to the best of my knowledge, is in excellent health and is guaranteed free from communicable disease. Said Puppy is of sound temperament, and is further guaranteed (under favorable conditions) against behavior atypical to the breed.
All puppies are veterinarian-checked, de-wormed and vaccinated. Buyer has been advised as to any pertinent medical history, including present status of immunity, and is hereby urged to have Puppy examined by a licensed veterinarian within seventy-two (72) hours from date when buyer assumes custody of puppy.
In the event that said Puppy, upon veterinary examination, is found to be sufficiently medically unsound as to warrant return, the Buyer shall immediately notify the Seller. The Puppy shall be returned, accompanied by a hand-written statement of all findings from said veterinarian on Veterinary letterhead: In which case, said Puppy shall be replaced with another puppy of equal value if one is available. It is Buyer’s monetary responsibility to return said Puppy to Seller. Any monies to be refunded, either in part or in whole, shall be at Seller’s option.
It is clearly understood that Seller shall NOT assume liability for veterinary expenses incurred by Buyer unless through prior arrangement: In which case, Seller reserves the right to choice of the treating veterinarian.
Any future claims made against this establishment/seller, based upon subsequent developments of a pathological nature traceable to genetic and/or congenital nature, shall be evaluated based upon the dog’s resulting physical incapacity to continue to serve the purpose for which it was purchased (e.g., family pet).It is further stated that seller does NOT guarantee ending size or color and further does not guarantee the fertility of the pet or whether or not the testicles (on males) have or will descend.(read further guarantee details at www.phantompartipoodles.com. This puppy is sold with full registration is it entirely to the buyers discretion to use or not use this puppy for breeding purposes.
We offer a Lifetime Return Policy of our dogs. If, for a valid reason, a Buyer can no longer keep the purchased dog, the Seller shall agree whenever possible to take said dog back from the Buyer and try to find it a good home.
Other than the terms stated above, Seller makes no further guarantees.
